SERVICE
By commissioning the artist in any form, the client agrees to the following Terms of Service.
The terms are possible to change with proper, prior discussion.
Section 1: PRIVACY
• Personal information will not be disclosed. Data, such as names, payment info, or other information of the artist and client are NOT be disclosed publicly on either side.
• If the client does not wish the commission to be posted online, they must request when ordering.
• NO AI or NFTs. Artist’s work will NOT be used for NFTs or AI generators.
Section 2: COPYRIGHT
• The artist retains full, exclusive rights to the commission. Client may not claim commission as their own.
• Artist reserves the right to:
claim the commission as their own.
modify, edit, repurpose the commission.
include the commission in their portfolios, online profiles, commission sheets, etc.
reproduce the commission for merchandising, like prints, T-shirts, etc.
post the commission on social media.
• Client does NOT have permission to:
claim the artwork as their own.
modify or edit the commission without permission, except for cropping / re-sizing the image.
use the commission as references for tracing or re-purposing parts of the image.
include the commission in their portfolios, commission sheets, etc.
reproduce the commission for merchandising, such as prints, T-shirts, etc.
• Client is allowed to post commission on social media, provided they give proper credit to the artist and links to where it was commissioned (VGen, Ko-Fi, etc.)
Section 3: PAYMENT
• TOTAL PRICE = ($20 Comm. Free) + (Commission Item Sum Total)
• 100% payment upfront. The commission will not start until 100% payment is confirmed.
• Personal Use purchase is the normal, total price.
• Commercial Use purchase is the total price plus 25% more. Example: (total price) * 1.25 = (total commercial price)
• Rush Fee will be an additional $15 only after commercial application. Ex: (Total Comm. Price + $20)
• Refund Policy:
If a refund is requested within 24 hours, a 50% refund will be given. Otherwise, no refunds allowed.
The artist reserves the right to cancel the commission at anytime, for any reason, without explanation.
If the artist cancel the commission due to my inability to, a full refund will be given.
Section 4: TIMELINE
• Commission details will be received and compiled from client using artist’s method, but can be discussed beforehand (via Google Doc or other usable methods).
• Artist works best with artistic freedom. The artist will do his best to match the client’s request, but the client should allow and expect slight variation.
• Estimated date for completion. Artist requires 2 weeks minimum, and may average 3 to 4 weeks depending on complexity of workload.
• Works in Progress (WIPs). Depending on the commission, artist will deliver WIPs to confirm progress.
• Edits and Revisions. The client can request a minor change to the WIP, but major revisions may include extra charges.
• After the commission has been approved and finished, if the client wishes for additional change, prices for edits may be discussed.
• If the artist makes any errors in a design specified in the given references, the artist will make these edits at no additional cost.
